At Peri, we are committed to helping you track and manage the symptoms you experience during perimenopause, while valuing your privacy and protecting your personal information. We understand that health information is sensitive and confidential by nature, and we want you to feel secure knowing how we handle your data. This Privacy Policy explains what information we collect when you visit our website and social media channels or use the Peri device and companion app (collectively referred to as the “Services”). This policy will explain why we collect it, how we use and share it, and how we keep it safe in accordance with U.S. and international laws. Please read this Privacy Policy carefully to understand our practices. By using our website, social media channels, Peri device, or app, you acknowledge and agree to the practices described in this Privacy Policy. Peri is the trading name for identifyHer Inc, the U.S. subsidiary of identifyHer Ltd, a company incorporated in Ireland. If you have any questions about how Peri protects your privacy, you can contact us through the information provided at the end of this policy.

Information We Collect

We collect various types of information to provide and improve our Services. This includes information you provide directly, data collected from your Peri device and app, and some data collected automatically when you interact with our website, social media or app. We do not collect personal data from third-party health platforms or other external sources – all health data we process comes from you and your use of Peri. Below we describe the categories of information we collect:

1. Information You Provide: When you purchase a Peri device, create an account, or use our app, you voluntarily provide personal information. This includes, as examples, your name, email address, mailing address, phone number, and account login credentials. You will also provide payment details (such as credit card information) to complete your purchase and for the payment of Membership fees. Additionally, you may provide profile details like your height, weight, date of birth and ethnicity – this helps personalize your experience. Because we focus on perimenopause health, we ask you to answer health questionnaires about your symptoms, menstrual cycle, medical history, and lifestyle. These responses are considered sensitive personal data as they relate to your health and demographic background. Providing this information is optional, but without it, you may not benefit from the full insights our Service offers. You may also provide information about additional symptoms you experience, changes in your dietary patterns and your menstrual cycle. We will always clearly indicate when we collect health-related or other sensitive information, and we obtain your consent where required by law before processing this data.

2. Biosignal and Device Data: When you use the Peri device, it continuously collects certain biosignal data to monitor aspects of your health and wellness. The types of biosignal data we collect includes measurements such as skin blood flow, skin temperature, galvanic skin response and movement. Collectively, these sensor readings indicate patterns that allow us to create digital biomarkers related to perimenopause symptoms. This data is transmitted from the device to our app and servers so we can analyze it and we present you with your symptoms profile (eg. hot flushes, night sweats, sleep disturbance, anxiety), other complementary information (eg. activity levels, menstrual cycle profile) and AI-based insights. In addition, our app may record how you use it – for instance, when you log certain symptoms or entries manually, those user inputs become part of your profile data. All biosignal measurements and in-app journal entries or symptom logs are stored securely in association with your account. Peri will also rely on trusted third-party data processors to process data on our behalf, such as our cloud service providers.

3. Cookies and Technical Data: When you visit our website, social media account or use our app, we automatically collect certain information about your device and how you interact with our Services. This includes things like your IP address, device identifiers, browser type, operating system, and referring website. Some of this information is necessary for cybersecurity and fraud prevention reasons, while others provide functional, performance or tracking information. If you use the Peri app, we collect device event information (e.g., when the device syncs with the app) and application analytics that help us understand app performance. We log usage data such as the pages or screens you view, the features you use, the time and duration of access, and any errors or crash reports. Our website and app use cookies and similar tracking technologies to remember your preferences and analyze your usage of the Services. For example, we may use cookies to keep you logged in on the website, or to gather analytics on how users navigate our site. We also use cookies and tracking pixels provided by our analytics and marketing partners to help measure the effectiveness of our website and outreach. You can manage cookie preferences through your browser settings; however, essential cookies are necessary for the website and app to function.

How We Use Your Information

Peri uses the collected information to provide, maintain, and improve our Services, as well as for other purposes described below. We always strive to use the minimum amount of personal data necessary for each purpose, and we prioritize privacy in our data practices. Here are the specific ways in which we use your information:

1. To Provide and Personalize the Service: We use your personal information, health questionnaire responses, and biosignal data to operate the Peri Services (Please see our Terms & Conditions for more information). This includes processing your data through our algorithms to detect symptoms and to profile patterns and trends that are presented to you using AI-generated insights about your own data (eg. the correlation between different symptoms). Importantly, these insights are for informational purposes and are not medical diagnoses or treatment recommendations. We also use your information to personalize your experience. If you log symptoms or feedback, we incorporate that to further customize the insights you see. Additionally, we use your shipping address to deliver your device and your email to send you account confirmations, receipts, and any reports you request. All these uses are necessary to fulfill our contract with you and provide the Services you expect.

2. To Improve and Develop Our Product: We continuously work to improve Peri – that means refining our AI models, enhancing device accuracy, and developing new features. Your data plays a critical role in this process. We may analyze users’ biosignal data and questionnaire answers in an aggregated, pseudonymized or anonymized manner to observe trends, validate our algorithms, and train our AI to be more accurate and effective. For example, by analyzing anonymized data from many users, we might detect common patterns that help us refine our insights. We may also conduct internal research on the data to advance scientific understanding of women’s health in midlife. When feasible, we use de-identified or aggregated data for these improvement efforts to protect your privacy. When information is aggregated or anonymized, it is no longer personal data. Any improvements or new features that result from this data analysis will benefit the user community. You will never be personally identified in any research findings or product development reports – we do not use your identifiable information in published research without your explicit consent. Using data for these purposes is in our legitimate interests to innovate, and, where required by law (for example, for use of sensitive health data in certain jurisdictions), we rely on your consent (which you give when you provide the data for these purposes).

3. To Communicate with You: We use your contact information (email address, phone number if provided) to communicate with you about the Services. This includes service and transaction messages: for example, we will email you a confirmation when you purchase a device or when your order ships. We might also email or in-app notify you about important updates, such as changes to this Privacy Policy or our Terms & Conditions, device firmware updates, or safety/security alerts. These service communications are necessary as part of our relationship with you. In addition, if you reach out to us with a question or request (for instance, contacting customer support), we will use your information to respond and resolve any issues. We maintain records of our communications with users to help in customer service and to ensure quality.

4. Marketing (With Your Consent): With your permission, we may also use your information to send you marketing communications about new features, products, newsletters, or events that Peri offers. We use a customer relationship platform to manage these communications, and it helps us tailor messages based on your interests or usage (e.g., we might send different content to a user who has been active in the app versus one who hasn’t set up their device yet). You have control over marketing messages – if you decide you no longer want to receive them, you can opt out at any time (described in the “Your Rights and Choices” section below). We will not spam you or inundate you with ads; and we do not share your personal data with third-party advertisers for their own marketing use. In fact, Peri does not sell or rent your personal information to anyone. Any promotional messages you receive will come directly from us, in line with your preferences. (Note: even if you opt out of marketing emails, we may still send necessary service emails as noted above.)

5. To Ensure Security and Prevent Fraud: We are committed to protecting our users’ data and our Services’ integrity. We use information we collect to monitor for potential security breaches, fraud, or misuse of our Services. For example, we may use your IP address and other device data to detect if an account login seems suspicious (such as logging in from an unusual location) and to implement access controls. We keep logs of activity to help troubleshoot bugs or investigate any incident. If necessary, we might use automated tools to screen for attacks or abusive behavior. We also utilize internal controls and auditing to ensure that only authorized personnel at Peri can access personal data, and only for legitimate purposes. This might include verification steps when you contact us (to confirm your identity before we give out information or make changes to your account). Using your data for security purposes is part of our legitimate interest in keeping our Services safe and is also often required to meet legal obligations regarding data protection.

6. To Comply with Legal Obligations: Like any company, Peri must follow the law. We may process and disclose your personal information when necessary to comply with applicable laws, regulations, legal processes, or government requests. For instance, we might need to verify your identity when you exercise privacy rights (as required by laws like CCPA). If we receive a valid legal order, such as a subpoena or court order, that requires us to share data, we will comply to the extent we are mandated to do so. However, we will push back on inappropriate or overly broad requests and will only disclose the minimum amount of information required. Where legally permitted, we would inform you if we ever have to provide your data to authorities. Additionally, we may use or disclose information to enforce our own legal rights and agreements – for example, to investigate violations of our Terms &Conditions or to defend Peri in legal proceedings. These uses are necessary for compliance and to protect the lawful interests of our company and our users. 

How We Share Your Information

Protecting your privacy is at the core of how we operate. We treat your personal information as confidential and do not share it with third parties except in the limited circumstances described here. We do not sell your personal data to anyone for money or other valuable consideration, and we do not share your data with third parties for their independent marketing or other purposes outside of providing our Services. When we do share data, we always ensure there is a valid reason and that appropriate safeguards are in place. The instances in which we may share user data are:

1. With Service Providers (Processors): We employ trusted third-party companies to perform certain business-related functions on our behalf – for example, to host data on cloud platforms, process payments, manage customer relationships, and ship orders. These providers are bound by contracts that limit their use of your data solely to providing services to Peri and that require them to protect your information. All these providers are only allowed to use your data to provide services to us, not for their own purposes. We also ensure any transfer of data to these providers is protected by appropriate legal mechanisms. Aside from the above, we may also engage other vendors for specialized services (for example, an email service to send out large volumes of emails, or analytics services to analyze app usage). We will update this Policy or provide notice if we significantly change our list of core service providers. Rest assured that every service provider is carefully vetted for security and privacy, and is required to meet our standards for data protection.

2. Within Our Corporate Group: Peri may share data internally between our offices, affiliates, or subsidiaries as necessary to operate the Service. For example, our Irish headquarters may have access to certain user data from our U.S.-based subsidiary to perform their role. All internal access to user data is restricted to personnel who need the information to do their job (such as customer support, engineers diagnosing a technical issue, or data scientists). Our staff are trained on confidentiality and are bound by strict employment policies to protect personal data. Access to sensitive data (like health info) is further limited to specialists and is pseudonymized where possible to reduce direct identification.

3. For Legal Compliance and Protection: We may disclose your information to third parties if required to do so by law or if such action is necessary to: (a) comply with a subpoena, court order, or legal process served on us; (b) enforce or apply our Terms of Service or investigate potential violations; (c) protect and defend the rights, property, or safety of Peri, our users, or others; or (d) investigate or assist in preventing any security or technical issues. For example, if law enforcement provides a lawful order for data related to an investigation, we will comply after verifying there quest’s validity. If we are ever compelled to disclose data, we will only provide the minimum information necessary and will, when possible, inform the affected users of the request (unless legally prohibited from doing so). We also reserve the right to use or disclose your data as needed to collect outstanding fees, to detect fraud, or to handle any disputes (which may involve sharing information with our legal advisors).

4. Business Transfers: If Peri is involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your information may be transferred as part of that transaction. In such cases, we will ensure the acquiring or succeeding entity is bound to respect your personal data in a manner consistent with this Privacy Policy (or will notify you and obtain consent if required by law for any changes in use).

5. Aggregated or De-Identified Data: We may share information that has been aggregated (combined with information of other users)or de-identified (stripped of personal identifiers) in a way that cannot reasonably be used to identify you. Such information is no longer personal data and may be used freely, for example in research publications, analytical insights, or to promote our Service (e.g., “X% of Peri users report improved symptom management”).We ensure that this data cannot be linked back to individuals before sharing it. For clarity, this kind of sharing does not include any information that could identify you personally.

International Data Transfers

Peri is headquartered in Ireland with a subsidiary in the United States, but we only offer and sell Peri to customers located in the United States and Canada currently. As such, our Services are not marketed to or intended for users in other countries, and we do not knowingly collect personal information from individuals in other regions.

All personal data collected from users through our website, app, or wearable device is stored and processed in the United States. We use U.S.-based cloud servers to store and manage this data. If you are a U.S. user your personal information will remain within the U.S. and will be handled in accordance with applicable U.S. privacy laws, including stronger protections in certain states such as California, where the California Consumer Privacy Act(CCPA) may apply.

In some cases, employees or contractors working for Peri who are located in Ireland may access personal data stored in the U.S. cloud environment for purposes such as data analysis, algorithm development, or customer support. This access is secure, role-based, and performed under strict confidentiality and data protection standards. While this access originates from outside the U.S., your data is not transferred out of the U.S., nor is it stored or processed on non-U.S. servers. We implement appropriate technical and organizational safeguards to ensure this remote access complies with U.S. legal standards and respects your privacy.

By using our Services, you acknowledge and agree that your personal data will be stored in and accessed from the United States, and that it may be viewed by Peri personnel located in other countries, including Ireland, in accordance with this Privacy Policy. If you reside in a U.S. state with enhanced privacy protections, such as California, your rights and our responsibilities under those laws remain fully in effect and are explained throughout this policy.

Data Retention and Deletion

We retain personal data only for as long as necessary to fulfill the purposes for which it was collected, or as required by law. How long we keep specific information varies depending on the type of data and the purposes of processing. Here is an overview of our retention practices:

For account and profile data, we keep your information while your account is active. This means we will retain your personal details (name, contact info, etc.), your questionnaire responses, and your biosignal data for as long as you continue to use Peri Services. Keeping this data is necessary to provide you with ongoing insights and historical trends – for example, past symptom logs need to be stored to show you changes over time. We do not set arbitrary expiration dates on active user data, because many users find long-term tracking valuable.

If you choose to delete your account or request deletion of your personal data, we honor those requests in accordance with applicable laws. You can delete your account through the app settings, your online account management or by contacting support. Once deletion is confirmed, we will take steps to remove or anonymize your personal information. This includes deleting identifiable profile information, contact details, and any other information that is linked to you as an individual. Essentially, we will scrub data that could be used to identify you personally from our production systems. However, please note that we may retain certain minimal information for record-keeping and legal compliance Any such retention will be limited to what is strictly necessary.

Importantly, we reserve the right to retain anonymized or de-identified data derived from your usage even after account deletion. This means that the raw sensor data and questionnaire responses you provided might be kept in a form that is no longer associated with your identity. We do this so that we can continue to improve our algorithms and gain insights into perimenopause health trends. For instance, we might keep an anonymized dataset of biosignals to analyze the efficacy of our AI, without any names or contact info attached. This data has no personal identifiers and cannot be traced back to you. We may retain such anonymized data indefinitely, as it is not considered personal information and helps us in research and development. Rest assured, if you delete your account, any data that remains is only used in aggregate form and cannot be used to identify or impact you.

Apart from account deletion, we also have standard retention periods: Operational data like server logs and device logs are usually kept for a short period (e.g., a few months) unless needed longer for security analysis. Cookies and analytics data have varying lifespans, but you can control cookie persistence via your browser. Our databases are routinely backed up for reliability, and those backups are retained for a limited time. It’s possible that fragments of your data could remain in encrypted backups for a short period after deletion, but we have processes to purge or overwrite old backups, and we will not restore deleted personal data except if required for a rare disaster recovery scenario (in which case we would re-delete it).If you have questions about our data retention or deletion practices, or if you want to request deletion, please see the “Your Rights and Choices” section and contact us.

Your Rights and Choices

You have rights and choices regarding your personal information. We believe it’s important that you can control your data, and we have processes in place to allow you to exercise these rights. The availability of certain rights may depend on your residency (for example, California residents have specific legal rights), but Peri’s policy is to extend a coreset of privacy rights to all our users, where feasible. Below, we outline these rights and how you can exercise them:

1. Right to Access Your Information: You have the right to request a copy of the personal data we hold about you and to obtain information about how it is processed, used, and shared. This is sometimes called the “Right to Know” or “Data Access” request. For example, you can ask us to confirm whether we are processing your personal data and provide you with a summary of the categories of data and specific pieces of information we have about you. We will provide this information in a format that is easy to understand, typically within 45 days (for California residents) of verifying your request, unless an extension is permitted. As a registered user, you already have direct access to much of your data via the app (you can view your logged health data, etc.), but you can also contact us for a full export.

2. Right to Correct Inaccurate Information: If you believe that any personal data we maintain about you is incorrect or incomplete, you have the right to request that we correct or update it. This is known as the right to rectification. In many cases, you can correct basic info yourself by logging into your account (e.g., updating your contact details via our app or website). For changes that you cannot make on your own, contact us with the specifics, and we will make the correction unless there is a valid reason not to (such as if we are unable to verify the correct information). We strive to ensure our records are accurate and will be happy to update any mistakes.

3. Right to Delete Your Information: You have the right to request deletion of your personal data. Upon your request (or if you delete your account), we will delete the personal information we have about you from our active systems, subject to certain exceptions we described in the Data Retention section above. Note that we might not be able to fully erase data that we are required to keep for legal reasons (for example, purchase history needed for financial auditing) or data that is stored in long-term backups, but we will let you know if any such exceptions apply. If we must decline a deletion request due to an exception, we will explain our reasoning. Deletion of your data is irreversible – if you ask us to delete your account, you will lose access to the Services and we won’t be able to recover that data later. Thus, please ensure you have exported any data you wish to keep (we can assist with providing you a copy before deletion if you wish). Once we process a deletion, your account and personal data are gone from our live databases.

4. Right to Data Portability: You have the right to obtain your personal data in a portable, commonly-used electronic format, so that you can transfer it to another service if you desire. In practice, this means you can request a copy of the data you provided to us (and data generated through your use of the Service) in a structured format, such as JSON or CSV. This typically overlaps with the right of access. For example, if you request an export of your questionnaire answers, we will provide them in a machine-readable file that you can then import to other tools or just keep for your own records. Data portability requests will be handled in the same time frame as access requests. We will directly provide the data to you (we cannot directly port it to another company’s system, but you are free to do so).

5. Right to Withdraw Consent (Opt-Out): If we are processing your personal information based on your consent, you have the right to withdraw that consent at any time. This most commonly applies to marketing communications and to certain health data processing in our context. For marketing emails, you can withdraw consent by clicking the “unsubscribe” linkin any promotional email, or by adjusting your email preferences in youraccount settings, or by contacting us. This will stop further marketing emails from us. If you had given consent for us to collect certain health data or to receive certain types of notifications, you can also revoke consent by changing the settings in the app or by contacting us for assistance. Please note that withdrawing consent for processing essential to the Service (such as processing of your health data for insights) may result in limited functionality or the need to discontinue service, since we cannot provide the core features without that data. We will inform you if this is the case. That said, you always have the right to withdraw consent for any optional processing without consequence to your Service usage (for instance, opting out of marketing will not affect your ability to use the device and app).

6. Right to Object or Restrict Processing: In certain situations, you may have the right to object to the processing of your personal data or ask us to restrict processing. If you object, we will review whether our legitimate grounds for processing outweigh your privacy rights; if they do not, we will cease the processing in question. You also have the right to object specifically to processing for direct marketing purposes – as noted, if you opt out of marketing, we will cease that use. If you believe we are processing your data unlawfully or want us to restrict processing while a complaint is being resolved, you can request a restriction. Restricting processing might mean we simply store your data but don’t actively use it until an issue is resolved. We will grant such requests to the extent required bylaw.

7. Additional California Privacy Rights: If you are a resident of California, the California Consumer Privacy Act (CCPA) (as amended by CPRA) provides certain additional rights. Most of these overlap with the rights already described (access/know, deletion, correction). California also gives you the right to opt out of the “sale or sharing” of personal information. As we have stated, Peri does not sell personal information to third parties, and we do not share it for cross-context behavioral advertising purposes in the manner that the CCPA defines as “sharing.”

California also allows users to limit the use of their sensitive personal information. We only use sensitive data (like health and ethnicity) for providing the Service and not for purposes like showing ads, so our use is considered “necessary” under the law and not something from which you need to opt out.

Lastly, California law provides a right to non-discrimination for exercising your privacy rights. Peri will never discriminate against you(e.g., deny you service, charge you a different price, or downgrade your experience) just because you exercised any of the rights described here. The Services we provide to you will remain the same whether or not you choose to exercise your privacy rights.

8. Exercising Your Rights: To exercise any of your privacy rights, please contact us using the information in the Contact section below. You can send us an email with your request (e.g., "I'd like a copy of my data" or "Please delete my account"). For certain requests, we might provide self-service tools: for example, account deletion or data download might be available in the app or account settings. If such tools are available, we will direct you to them for the fastest service. Otherwise, upon receiving your request, we will take steps to verify your identity for security– we may ask you to confirm some personal details we have on file, or take similar measures, just to ensure it’s really you (and not an unauthorized person) making the request. After verification, we will proceed to fulfill your request within the timeframe required by law. You have the right to make a free request for access, portability, correction, and deletion requests up to two times in any 12-month period. We will inform you once your request is completed or if we need additional time. If for some reason we cannot fulfill a request in part or in full (due to a legal exception or conflicting right), we will explain that to you. For example, if you request deletion but we must retain certain data for legal reasons, we will let you know what we cannot delete and why.

If you have any questions about your rights or how to exercise them, you can always reach out to us. We’re here to help you feel confident and in control of your personal data. And if you feel we have not adequately addressed your concerns, you have the right to request an appeal and we will resolve your appeal within the time frames established by applicable laws. If you are still not satisfied with the outcomes, you can lodge a complaint with the regulator in your jurisdiction that handles privacy complaints. For California users, that could be the California Privacy Protection Agency. We would appreciate the chance to address your concerns first, so please consider contacting us before involving regulators.

Security Measures to Protect Your Data

Peri takes the security of your personal information veryseriously. We implement a variety of technical, administrative, and physicalsafeguards to protect against unauthorized access, alteration, disclosure, ordestruction of your data. While no system can be 100% secure, we followindustry best practices and continually improve our security to minimize risks.Here are key security measures we have in place:

Encryption: All data transmitted between your Peri device, our app, and our servers is encrypted in transit using TLS (Transport Layer Security). This means that when your biosignal data uploads or when you log into your account, the information is scrambled so that no eavesdropper can read it. Additionally, we encrypt sensitive data at rest in our databases. Personal information and health data stored on our servers (for example, in our AWS databases) are encrypted using strong encryption algorithms. Encryption is a critical safeguard to ensure that even if someone were to gain unauthorized access to our data storage, they would not be able to decipher your information without the encryption keys. Using encryption for data in transit and at rest is encouraged by modern privacy laws and standards, and we make full use of it.

Access Controls and Data Segregation: We employ strict access controls to limit who at Peri can see personal data. Staff access to databases requires authorization, and we segregate duties so that no single person can export or misuse data without oversight. Data Scientists may have access to anonymized data sets for improving the AI, but not to your identifiable profile. We maintain logs of access to personal data and regularly review them to detect any unauthorized access. Each user’s data is isolated and protected so that only you (through your account) and authorized service processes can link your identity to your health data. Internally, we often separate personal identifiers (like your name or email) from health data by using unique ID codes – a technique called pseudonymization – so that even within our system, the data is in a protected form. Only when necessary do we combine those pieces, for example, to show you your own data in the app.

Organizational Policies: We have internal security policies and training for employees to ensure everyone understands how to protect user data. All employees and contractors with access to personal data sign confidentiality agreements. We also perform background checks where permitted by law for those with significant data access. Our team is trained on privacy and security practices, including how to identify phishing attempts or social engineering, to avoid human error breaches. We limit the use of portable storage or printing of personal data. When employees leave Peri or change roles, their access is promptly revoked or adjusted. We also conduct periodic reviews and audits of our security practices, and may employ third-party security experts to test our systems (penetration testing).

Technical Safeguards: Our systems are protected by firewalls and network security monitoring to guard against external attacks. We use up-to-date antivirus and anti-malware tools on our endpoints. Software and firmware are kept updated to patch vulnerabilities. We also implement rate-limiting and other protections on our APIs to prevent misuse. For the device and app specifically, we use secure protocols for syncing data. We have mechanisms to detect intrusion or anomalous behavior in our infrastructure, and an incident response plan to promptly address any security events.

Data Segregation & Anonymization: Wherever possible, we separate or anonymize data as an added layer of protection. We keep production (live user) data separate from testing environments. If we ever use real data for testing improvements, we strip it of identifying details. By segregating personal data from general data and by anonymizing data when we can, we reduce the risk to you in the unlikely event of a breach.

Third-Party Security: When we use third-party service providers, we ensure that they also employ robust security measures. AWS, for instance, is an industry leader in cloud security and provides many built-in safeguards we leverage (such as encrypted storage, security monitoring tools, etc.). We choose partners who have strong security track records and certifications (for example ISO 27001). We also ensure through contracts that they are obligated to protect your data to the same standards we uphold.

Despite all these precautions, it’s important to note that no method of transmitting or storing data can be guaranteed as completely secure. In the unlikely event of a security breach that affects your personal data, Peri will act swiftly to contain the issue and will notify you and relevant authorities as required by law. We abide by breach notification laws, meaning if your data’s confidentiality was compromised, we will let you know in a timely manner with information on what happened and what we are doing about it.
